Economic experts in arbitrations – new horizons and challenges

November 28, 2024

We thank the Russian Arbitration Association for the opportunity to participate in the annual conference.

Our partner - Vladimir Nefediev, shared views on current arguments in economics and new areas of analysis for economic experts.

Amid sanctions and restrictions:

◾ Contract violations (in particular take or pay obligations) and supply agreements on the targeted sales market are observed. The economic expert is required to analyse alternative markets for the product, their capacity and pricing.

◾ Withdrawal from contracts for the supply of complex and/or business-critical equipment or components (raw materials). Consequently, the productivity and profitability of the projects fall. In such cases, the expert uses more complex and detailed DCF models to calculate the damage.

◾ To assess damages in circumstances of sanctions and restrictions, it is becoming more important to build scenario analyses in DCF models.
